8 1 Short title
9 This Act is the Appropriation (Parliamentary Departments) Act
10 (No. 1) 2017-2018.

1 2 Commencement
2 (1) Each provision of this Act specified in column 1 of the table
3 commences, or is taken to have commenced, in accordance with
4 column 2 of the table. Any other statement in column 2 has effect
5 according to its terms.

13 3 Definitions
14 In this Act:
15 administered assets and liabilities item means an amount set out in
16 Schedule 1 in relation to a Parliamentary Department opposite the
17 heading “Administered Assets and Liabilities”.
18 administered item means an amount set out in Schedule 1 opposite
19 an outcome for a Parliamentary Department under the heading
20 “Administered”.
21 current year means the financial year ending on 30 June 2018.
22 departmental item means the total amount set out in Schedule 1 in
23 relation to a Parliamentary Department under the heading
24 “Departmental”.

1 Note: The amounts set out opposite outcomes, under the heading
2 “Departmental”, are “notional”. They are not part of the item, and do
3 not in any way restrict the scope of the expenditure authorised by the
4 item.
5 expenditure means payments for expenses, acquiring assets,
6 making loans or paying liabilities.
7 item means any of the following:
8 (a) a departmental item;
9 (b) an administered item;
10 (c) an administered assets and liabilities item;
11 (d) an other departmental item.
12 non-corporate entity means:
13 (a) a non-corporate Commonwealth entity within the meaning of
14 the Public Governance, Performance and Accountability Act
15 2013; or
16 (b) the High Court.
17 Note: Each Parliamentary Department is a non-corporate Commonwealth
18 entity for the purposes of the Public Governance, Performance and
19 Accountability Act 2013.
20 other departmental item means an amount set out in Schedule 1 in
21 relation to a Parliamentary Department opposite the heading
22 “Equity Injections”.
23 Parliamentary Department means any of the following:
24 (a) the Department of the Senate;
25 (b) the Department of the House of Representatives;
26 (c) the Department of Parliamentary Services;
27 (d) the Parliamentary Budget Office.
28 Portfolio Budget Statements means the Portfolio Budget
29 Statements that were tabled in the Senate or the House of
30 Representatives in relation to the Bill for this Act.
31 portfolio statements means the Portfolio Budget Statements.
32 President means the President of the Senate.

Section 4
1 responsible Presiding Officer means:
2 (a) in relation to the Department of the Senate—the President; or
3 (b) in relation to the Department of the House of
4 Representatives—the Speaker; or
5 (c) in relation to the Department of Parliamentary Services—the
6 President and the Speaker together; or
7 (d) in relation to the Parliamentary Budget Office—the President
8 and the Speaker together.
9 Speaker means the Speaker of the House of Representatives.
10 special account has the same meaning as in the Public
11 Governance, Performance and Accountability Act 2013.
12 4 Portfolio statements
13 The portfolio statements are declared to be relevant documents for
14 the purposes of section 15AB of the Acts Interpretation Act 1901.
15 Note: See paragraph 15AB(2)(g) of the Acts Interpretation Act 1901 which
16 provides that the material that may be considered in the interpretation
17 of a provision of an Act includes any document that is declared by the
18 Act to be a relevant document.
19 5 Notional transactions between entities that are part of the
20 Commonwealth
21 For the purposes of this Act, notional transactions between
22 non-corporate entities are to be treated as if they were real
23 transactions.
24 Note: This section applies, for example, to a “payment” between
25 non-corporate entities that are both part of the Commonwealth. One of
26 the effects of this section is that the payment will be debited from an
27 appropriation for the paying non-corporate entity, even though no
28 payment is actually made from the Consolidated Revenue Fund. This
29 is consistent with section 76 of the Public Governance, Performance
30 and Accountability Act 2013.

3 6 Summary of appropriations
4 The total of the items specified in Schedule 1 is $326,129,000.
5 Note 1: Items in Schedule 1 can be adjusted under Part 3 of this Act.
6 Note 2: Sections 74 to 75 of the Public Governance, Performance and
7 Accountability Act 2013 also provide for the adjustment of amounts
8 appropriated by this Act.
9 7 Departmental items
10 The amount specified in a departmental item for a Parliamentary
11 Department may be applied for the departmental expenditure of the
12 Parliamentary Department.
13 8 Administered items
14 (1) The amount specified in an administered item for an outcome for a
15 Parliamentary Department may be applied for expenditure for the
16 purpose of contributing to achieving that outcome.
17 (2) If the portfolio statements indicate that activities of a particular
18 kind were intended to be treated as activities in respect of a
19 particular outcome, then expenditure for the purpose of carrying
20 out those activities is taken to be expenditure for the purpose of
21 contributing to achieving the outcome.
22 9 Administered assets and liabilities items
23 (1) The amount specified in an administered assets and liabilities item
24 for a Parliamentary Department may be applied for expenditure for
25 the purpose of contributing to achieving any outcome specified in
26 Schedule 1 for the Parliamentary Department.
27 (2) If the portfolio statements indicate that activities of a particular
28 kind were intended to be treated as activities in respect of a
29 particular outcome, then expenditure for the purpose of carrying

1 out those activities is taken to be expenditure for the purpose of
2 contributing to achieving the outcome.
3 10 Other departmental items
4 The amount specified in an other departmental item for a
5 Parliamentary Department may be applied for the departmental
6 expenditure of the Parliamentary Department.

4 11 Advance to the responsible Presiding Officer
5 (1) This section applies if the responsible Presiding Officer is satisfied
6 that there is an urgent need for expenditure in relation to a
7 Parliamentary Department, in the current year, that is not provided
8 for, or is insufficiently provided for, in Schedule 1:
9 (a) because of an erroneous omission or understatement; or
10 (b) because the expenditure was unforeseen until after the last
11 day on which it was practicable to provide for it in the Bill
12 for this Act before that Bill was introduced into the House of
13 Representatives.
14 (2) This Act has effect as if Schedule 1 were amended, in accordance
15 with a determination of the responsible Presiding Officer, to make
16 provision for so much (if any) of the additional expenditure as the
17 responsible Presiding Officer determines.
18 (3) The total of the amounts determined under subsection (2) for the
19 Department of the Senate cannot be more than $300,000.
20 (4) The total of the amounts determined under subsection (2) for the
21 Department of the House of Representatives cannot be more than
22 $300,000.
23 (5) The total of the amounts determined under subsection (2) for the
24 Department of Parliamentary Services cannot be more than $1
25 million.
26 (6) The total of the amounts determined under subsection (2) for the
27 Parliamentary Budget Office cannot be more than $300,000.
28 (7) A determination made under subsection (2) is a legislative
29 instrument, but neither section 42 (disallowance) nor Part 4 of
30 Chapter 3 (sunsetting) of the Legislation Act 2003 applies to the
31 determination.

3 12 Crediting amounts to special accounts
4 If any of the purposes of a special account is a purpose that is
5 covered by an item (whether or not the item expressly refers to the
6 special account), then amounts may be debited against the
7 appropriation for that item and credited to that special account.
8 13 Appropriation of the Consolidated Revenue Fund
9 The Consolidated Revenue Fund is appropriated as necessary for
10 the purposes of this Act, including the operation of this Act as
11 affected by the Public Governance, Performance and
12 Accountability Act 2013.
13 14 Repeal of this Act
14 This Act is repealed at the start of 1 July 2020.
