Any other statement in column 2 has effect according to its terms. Commencement information Column 1 Column 2 Column 3 Provisions Commencement Date/Details 1. The whole of 1 July 2019. 1 July 2019 this Act Note: This table relates only to the provisions of this Act as originally enacted. It will not be amended to deal with any later amendments of this Act. Information may be inserted in this column, or information in it may be edited, in any published version of this Act. 3 Act binds the Crown This Act binds the Crown in each of its capacities. 4 Extension to external Territories This Act extends to the external Territories. 5 Object of this Act (1) The object of this Act is to: (a) restrict hydraulic fracturing; and (b) meet Australia’s obligations to various emissions treaties and agreements. Division 2—Definitions 6 Definitions In this Act: Hydraulic fracturing means the injection of a substance or substances into a bore under pressure for the purposes of stimulating a geological formation. Exploration licence means a state or territory licence granting a person the ability to carry out the exploration of a mineral or petroleum. Mining licence means a state or territory licence granting a person the ability to carry out the mining of a mineral or petroleum. Retention licence means a state or territory licence granting a person the ability to hold a mineral or petroleum. Part 2—Restrictions 7 Restriction on the use of hydraulic fracturing A person must not carry out hydraulic fracturing. 8 Licences No state or territory shall grant an exploration licence, a mining licence or a retention licence that relates to hydraulic fracturing. 9 Licence surrender The issuer must repurchase any issued exploration licence, mining licence or a retention licence that relates to hydraulic fracturing within 12 months of this bill be assented at the same price that the licence was issued.
